Terms of Service

By creating an account, starting a subscription, or using Lovina, you agree to these Terms of Service, our Privacy Policy, Cookie Policy, Community Guidelines, and Safety page. If you do not agree, do not use the service.

If you use Lovina on behalf of an organization, you represent that you have authority to bind that organization.

You must be at least 18 years old and able to form a binding contract in your jurisdiction.

Adult or explicit features require additional age verification on Premium, Elite, and other eligible paid plans, and remain opt-in at all times.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Lovina provides AI-generated companionship, conversation, voice, memory, and optional media features. Companions are artificial intelligence systems — not humans, professionals, or real relationships.

Features, pricing, and availability may change. We may add, modify, or discontinue features with reasonable notice where practicable.

Paid plans renew automatically at the interval shown at checkout (monthly or annual) unless you cancel before the renewal date through your account or by contacting support.

Prices, taxes, and currency are displayed at checkout. We may change prices for future billing periods with advance notice; continued use after the effective date constitutes acceptance for renewal periods.

Credits for photos, moments, and media are allocated per billing period as described on the pricing page. Unless explicitly stated, unused credits do not roll over.

Free trials, where offered, convert to paid subscriptions unless cancelled before the trial ends. Trial eligibility may be limited to new subscribers.

You agree not to:

• Violate any law or third-party rights.
• Harass, threaten, defame, or harm others.
• Request, generate, or distribute content involving minors, non-consensual sexual content, extreme violence, terrorism, or illegal activity.
• Impersonate real people without consent or create deepfakes intended to deceive.
• Attempt to bypass safety systems, scrape the service, probe vulnerabilities, or overload infrastructure.
• Resell, sublicense, or commercially exploit Lovina except as expressly permitted.
• Use automated means to access the service except via documented APIs we provide.

You retain ownership of content you submit ("Inputs"). You grant Lovina a worldwide, non-exclusive license to host, process, and display Inputs solely to operate and improve the service, enforce policies, and comply with law.

Subject to these Terms, Lovina grants you a personal, non-transferable, revocable license to use AI-generated outputs ("Outputs") for lawful private purposes. Outputs may not be unique; similar outputs may be generated for others.

You are responsible for your Inputs and use of Outputs. Do not rely on Outputs for medical, legal, financial, or safety-critical decisions.

Lovina, our logos, software, companion personas (except user-customized elements), and site content are owned by Lovina or our licensors. These Terms do not grant you rights to our trademarks or brand except limited use to refer to the service.

Companions may produce inaccurate, offensive, or emotionally misleading content. Lovina is not a substitute for professional medical, mental health, legal, or crisis services.

If you are in crisis or danger, contact local emergency services immediately. In the U.S., dial or text 988 for the Suicide & Crisis Lifeline.

You may stop using Lovina and cancel subscriptions at any time. We may suspend or terminate access if you violate these Terms, pose risk to users or the platform, or where required by law.

Upon termination, your right to use the service ends. Provisions that by nature should survive (payment obligations, disclaimers, limitations, dispute resolution) will survive.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOVINA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOVINA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID LOVINA IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100, EXCEPT WHERE LAW PROHIBITS SUCH LIMITS.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

You agree to indemnify and hold harmless Lovina from claims, damages, and expenses (including reasonable legal fees) arising from your use of the service, your Inputs, your violation of these Terms, or your violation of third-party rights.

If you are an EU/EEA consumer, you may have a 14-day right to withdraw from distance contracts. By starting digital content immediately, you may be asked to consent to immediate performance and acknowledge that you lose the withdrawal right once delivery begins, as permitted by law.

Subscription refunds after withdrawal periods are governed by our Refund Policy and mandatory consumer law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your country of residence apply.

For U.S. users, disputes will be resolved by binding individual arbitration under the AAA Consumer Arbitration Rules, except you may bring claims in small-claims court and either party may seek injunctive relief for intellectual property misuse. CLASS ACTIONS AND CLASS ARBITRATIONS ARE WAIVED TO THE EXTENT PERMITTED BY LAW.

We may update these Terms. Material changes will be notified by email or in-app notice at least 30 days before the effective date where required. Continued use after the effective date constitutes acceptance.
